1. Introduction

Welcome to Carbnb.my ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our website, mobile application, and car subscription services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Eligibility

To use our car subscription services, you must:

• Be at least 21 years of age
• Hold a valid Malaysian driving license for at least 2 years
• Have a clean driving record with no major traffic violations in the past 3 years
• Be a Malaysian citizen or permanent resident, or hold a valid work permit
• Meet our credit assessment requirements
• Provide accurate and complete information during registration

3. Car Subscription Services

3.1 Subscription Plans

Carbnb.my offers flexible car subscription plans ranging from 1 to 60 months. Each subscription includes:

• Comprehensive insurance coverage
• Road tax renewal
• Regular maintenance and servicing
• 24/7 roadside assistance
• Concierge services

3.2 Vehicle Delivery and Return

We will deliver your subscribed vehicle to your designated location within Peninsular Malaysia. Upon subscription termination, you must return the vehicle in the same condition as received, subject to normal wear and tear.

3.3 Vehicle Swap

Depending on your subscription plan, you may be eligible to swap your vehicle for a different model. Vehicle swaps are subject to availability and may incur additional fees.

4. Payment Terms

• Subscription fees are charged monthly in advance
• A security deposit equivalent to one month's subscription fee is required
• All payments must be made via the approved payment methods on our platform
• Late payments may result in service suspension and additional charges
• Prices are quoted in Malaysian Ringgit (MYR) and are inclusive of SST where applicable

5. Your Responsibilities

As a subscriber, you agree to:

• Use the vehicle only for lawful purposes
• Not allow unauthorized persons to drive the vehicle
• Maintain the vehicle in good condition
• Report any accidents, damage, or mechanical issues immediately
• Not modify or alter the vehicle in any way
• Not use the vehicle for commercial purposes (e.g., ride-hailing, delivery services) unless explicitly permitted
• Comply with all traffic laws and regulations
• Not take the vehicle outside Malaysia without prior written consent

6. Insurance and Liability

Your subscription includes comprehensive insurance coverage. However, you may be liable for:

• Excess amounts in the event of a claim
• Damage caused by negligence or violation of these Terms
• Traffic fines and penalties incurred during your subscription period
• Loss or damage to personal belongings left in the vehicle

7. Cancellation and Termination

7.1 Cancellation by You

You may cancel your subscription by providing written notice. Early termination fees may apply depending on your subscription plan and remaining contract period.

7.2 Termination by Us

We reserve the right to terminate your subscription immediately if you breach these Terms, fail to make payments, or engage in fraudulent activity.

8. Limitation of Liability

To the maximum extent permitted by law, Carbnb.my shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the amount paid by you for the Services in the 12 months preceding the claim.

9. Intellectual Property

All content, trademarks, logos, and intellectual property on our platform are owned by Carbnb.my or our licensors. You may not use, reproduce, or distribute any content without our prior written consent.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or through our platform. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.
